Evolutions Power Performance

Participation Waiver and Consent

Read this document carefully before signing. The optional public-media permission is separate from the training-video permission needed for coaching. A parent or guardian accepts this waiver electronically through the EPP Softball Liability Waiver & Consent form.

Activities Covered

I give permission for the Athlete to participate in in-person and virtual services provided by Evolutions Power Performance, LLC (hereafter referred to as "EPP"), including fastpitch pitching and throwing, catching-related drills, movement training, running, speed and agility work, strength and power training, plyometrics, resistance bands, medicine balls, free weights, mobility, arm care, recovery activities, mental-performance exercises, video analysis, and related instruction.

Acknowledgment of Inherent Risks

I understand that athletic training involves inherent and other risks, including falls, collisions, being struck by a ball or equipment, overuse, strains, sprains, fractures, head injury, heat illness, aggravation of an existing condition, and other serious injury. Equipment, flooring, turf, nets, balls, bands, weights, other participants, travel to and from training, and the Athlete's own movement may create risks even when reasonable care is used. I understand that EPP cannot eliminate every risk and does not guarantee that the Athlete will remain injury-free or achieve a particular result.

Third-Party Facility Rental & Space Disclaimer

I explicitly acknowledge and agree that EPP does not own, operate, manage, or maintain the physical facilities, fields, batting cages, or buildings where the training takes place. EPP merely rents designated, temporary time slots from third-party facility owners/operators. EPP will make all reasonable efforts to ensure the safety of all players during our active coaching sessions. However, because EPP does not manage or own the infrastructure, I agree that EPP, its owners, members, and coaches are not responsible for the structural condition, physical maintenance, property design, hidden hazards, or defects of the premises, flooring, turf, netting, lighting, or equipment provided by the host facility. I release EPP from any liability stemming from facility-related structural accidents or premises liability. Furthermore, I agree that the Athlete will abide by all safety rules and regulations enforced by the host facility.

Communicable Disease Waiver

While EPP implements reasonable preventative measures, EPP cannot guarantee that the Athlete or family members will not become infected with communicable diseases, viruses, or illnesses (including but not limited to influenza, MRSA, or other community-spread outbreaks) while attending sessions. By signing below, I voluntarily assume the risk that my child and I may be exposed to or infected by a communicable disease by attending training, and I voluntarily choose to release, waive, and hold harmless EPP from any claims related to such exposure or illness.

Health, Disclosure, and Safety Rules

  • The Athlete is physically able to participate except for restrictions disclosed in writing to EPP.
  • The Parent/Guardian will promptly disclose current pain, injury, concussion concerns, medical restrictions, conditions relevant to exercise safety, and medications or allergies relevant to an emergency.
  • The Athlete will follow coaching instructions, use equipment only as directed, and stop for sharp pain, joint pain, dizziness, breathing difficulty, chest pain, or pain-altered motion.
  • The Parent/Guardian is responsible for age-appropriate supervision and a safe, clear training area during virtual or at-home sessions.
  • EPP may stop participation and may request medical clearance when safety requires it.

Assumption of Risk

Knowing the nature of these activities and risks, I voluntarily choose for the Athlete to participate and assume the inherent risks of participation on behalf of myself and, to the extent permitted by law, on behalf of the Athlete.

Release and Limitation

To the fullest extent permitted by New Jersey law, I release and hold harmless Evolutions Power Performance, LLC, Jolynn Di Ienno, its coaches, contractors, volunteers, host facilities, and their respective owners, employees, and agents from claims arising from the ordinary inherent risks of the Athlete's voluntary participation or ordinary negligence. This provision is not intended to release gross negligence, recklessness, intentional misconduct, or any right that cannot lawfully be waived. I understand that laws governing a minor's claims may limit the effect of a parent/guardian release. This agreement is intended to be enforced only to the maximum extent the law permits; any unenforceable portion will be limited or severed without invalidating the remaining provisions.

Emergency Medical Authorization & Financial Responsibility

If I cannot be reached in an emergency, I authorize EPP and the host facility to contact emergency services and to provide or arrange reasonable first aid and emergency medical evaluation or treatment for the Athlete. I understand that EPP is not a medical provider and cannot guarantee the availability or outcome of care. I accept full responsibility for all medical costs, expenses, and bills not covered by my personal health insurance.

Training Video Consent (Required for Video Coaching and Athlete Video Uploads)

I authorize the Athlete and/or Parent/Guardian to submit training videos to EPP through CoachIQ or another EPP-approved method. I authorize EPP to view, annotate, store, and use those videos privately for instruction, progress review, safety documentation, and development of the Athlete's individualized plan. This permission does not authorize public posting, advertising, or use as another athlete's demonstration.

Optional Public Photo / Video Permission

Choose one. Saying no does not affect the Athlete's eligibility for coaching.

I may withdraw future public-media permission by sending written notice to jolynn@evolutionspowerperformance.com. Withdrawal applies prospectively and may not remove material already printed, lawfully distributed, or reposted by others.

Conduct and Privacy

  • The Athlete and family will treat coaches, other athletes, families, staff, and facilities respectfully.
  • The family will not record or share another athlete without that athlete's parent/guardian permission.
  • The family will not redistribute private EPP training content, messages, or another athlete's information.

Governing Law and Understanding

This agreement is governed by New Jersey law. I have read it, understand that it affects legal rights, have had the opportunity to ask questions, and sign it voluntarily. Electronic acceptance through CoachIQ is intended to have the same effect as a handwritten signature.
